Tax Residence Certificate in UAE: Know the procedure or Tax Residence Certificate: Know how to obtain it

Obtaining a tax residence certificate (TRC) is a prerequisite for tax resident persons in the UAE. Tax residents in the UAE are those juridical and natural persons who are liable to pay tax in the UAE. The purpose of obtaining a TRC can be general or for avoidance of double taxation. The Federal Tax Authority (FTA) is the one that issues a TRC to a tax resident person who applies. The TRC is the proof that a person is a tax resident in the UAE and pays tax here.

Steps to Obtain a TRC in UAE

Following is a step-by-step guide on how you can obtain a TRC in UAE;

  1. Open the FTA EmaraTax portal on your browser.
  2. When you see the login interface, insert your login credentials and log into the EmaraTax. If you don’t have an account yet, you can create a new account.
  3. As soon as you are logged in, look for the “other services” option and click on it.
  4. You will find the option “tax residency certificate”. Click on that.
  5. You will find the option to add your TRN (tax registration number) for CT (corporate tax). There will also be an option for “No TRN”. If you don’t have a TRN, select “no TRN”. However, providing a TRN will automatically fill in your details in the application and it will also reduce costs for the application. Moreover, if you are applying for DTA purposes, the other state can request a TRN.
  6. Next, you will have to select which type of TRC you are applying for i.e., general or for DTA purposes. If the DTA type is chosen, you will also have to add the country name.
  7. Add other information that is required and upload required documents.
  8. After this, you will have to pay application submission charges.
  9. Now you will be able to submit your application.
  10. The FTA will review your application once it is submitted.
  11. After the FTA approves your application, it will charge you processing fees which need to be paid within the next 30 days. If not paid within this deadline, your application will be cancelled. Then you will have to repeat the whole process from the start.
  12. After the whole process is completed, you will be able to download your TRC from the Emaratax platform. It will also be sent to your provided email address. In addition, you can request printed copies of TRC to be delivered to your given address by courier. The cost of a printed copy is AED 250 per copy

Documents Required for TRC Application

For natural persons, the following information and documentation can be required;

  • Emirates ID of the applicant
  • Resident Visa of the applicant
  • Passport Copy & entry and exit report
  • Proof of business or employment
  • Proof of permanent residence
  • Proof of income source.
  • Stamped bank statements for at least 6 months during the required year
  • Immigration report of residency containing details of entry into and exit from UAE. Proving that the applicant has been a resident of UAE for at least 180 days
  • Country name for which certificate is to be applied
  • Financial Year for which TRC is required
  • Proof of personal interests
  • Any other information as required

For juridical persons, the following information and documentation can be required;

  • Lease agreement
  • Business licence
  • TRN for CT UAE
  • Incorporation certificate
  • Certified copy of MoA (Memorandum of Association)
  • Name, passport and ID of authorised signatory.
  • PoA (power of attorney) or establishment card of authorised signatory.
  • Proof that the business is controlled and managed entirely within the UAE.

How does the FTA respond to the application?

When a complete application is submitted, the FTA takes up to 10 days to respond to the application. Either the application is approved or rejected or FTA can ask for more information. The business has 30 days to respond to the FTA if it requires further information. If the applicant applies for printed copies of TRC, the FTA will respond in 5 days at least.
